Terms and conditions

 

All orders are subject to the following terms and conditions. These terms and conditions do not affect your statutory rights as a consumer.

Feel free to contact us if there is anything you would like us to clarify.

Please read before paying the deposit, receipt of a deposit is confirmation that you have read and accepted our terms and conditions.

 

 

1. Consultations

1.1 Wedding cake consultations are arranged by appointment only. Appointments can be made via email, phone or the Contact page on our website. Appointments are approximately one hour long. 

1.2 Please advise us of any allergies or specific dietary requirements when booking your consultation. Whilst we try to ensure our gluten-, dairy- or egg-free cakes are free from  gluten, dairy or eggs we cannot guarantee this as we use these items in our cake studio. If the allergy is severe we don't recommend buying your cake from us.

 

2. Deposits

2.1 The payment of a non-refundable deposit of £100 is required for all wedding cake orders and a non-refundable deposit of £25 for all other cake orders. For wedding cakes ordered with less than two weeks’ notice the full cost of the cake must be paid at the time of booking.

2.2 Following your wedding cake consultation we will reserve the delivery/collection date for seven days. Dates cannot be reserved for longer without a deposit. If the deposit is not received within seven days, the date will no longer be reserved for you and another booking may be taken.

2.3 Your order will be confirmed when the deposit is paid. Please note that all deposits are non-refundable and non-transferable.

 

3. Final Payments

3.1 The balance must be paid 14 days in advance of the delivery/collection date; if not, we reserve the right to cancel your booking. The date on which the balance is due will be clearly stated in the follow-up email and you will receive a reminder a week in advance of this date.

3.2 Payments can be made in instalments.

 

4. Order Amendments

4.1 We are happy to make amendments to your order as requested; however, changes requested less than two weeks prior to your delivery/collection date cannot be guaranteed. Any changes made to the original order must be made in writing by email. 

4.2 Following your consultation you will receive a follow-up email formalising the details of your order, such as names or other text included in the design and the date, time and venue address. Please take the time to check these details and let us know if you would like to make any changes.

4.3 It is your responsibility to advise us of any amendments to the original order. If you request an amendment to the original order, we reserve the right to adapt the price accordingly.

 

5. Collection

5.1 We prefer to deliver wedding cakes; however, where this is not possible, you may collect your order at a pre-arranged time. Only certain cakes may be collected, subject to their design and size. Cakes of more than three tiers or with intricate decoration may not be suitable for customer collection.

5.2 We will box cakes due for customer collection. We will provide full instructions on the handling of your cake. Upon collection of your order, we require a signature confirming that you have received your order in perfect condition and that the specifications given by you have been met. We will not take responsibility for any damage sustained to your order after you have taken it from our studio.

5.3 We advise that you place your cake on a level surface for transportation e.g., in the boot of your car. It should then be stored at room temperature and away from direct sunlight.

 

6. Delivery & Set-Up

6.1 We will deliver your wedding cake to the venue at a pre-arranged time. This will be discussed during your consultation and we will advise the venue of our arrival time in advance.

6.2 Delivery of wedding cakes to local venues is free; regarding all other venues, there is a delivery charge, depending on the venue’s location and distance from our studio.

6.3 The delivery includes the set-up of your wedding cake at the venue.

6.4 It is your responsibility to ensure you have given us the correct information regarding the delivery of your order. Please inform us of changes to the venue or time as soon as possible, as we cannot guarantee that we will be able to accommodate such changes.

6.5 Although we will make every effort to deliver your order as arranged, it is possible that, on the date of your event, circumstances will arise which make the delivery of your order impossible (e.g., severe weather conditions, public unrest, etc.). Please ensure that you have adequate wedding insurance to cover such an eventuality.

6.6 It is your responsibility to ensure that you have provided us with the correct set-up details for your order. We will not take responsibility for the incorrect set-up of your order (including the location of your cake within the venue) where incorrect details have been provided to us. Please ensure that your chosen display location is level, stable and strong enough to hold the cake. We also advise that it is not directly in front of a heat source, in direct sunlight or in a location where it could easily be knocked over by guests or staff.

6.7 We will photograph your cake at the venue as proof that it has been delivered and set up and that we have left it in perfect condition. After we have delivered your cake, we will not take responsibility for any damage.

6.8 All cakes other than wedding cakes are for collection, it may be possible to deliver cakes locally, please ask for delivery charges.

 

7. Non-edible Elements

7.1 Most of our stacked cakes contain non-edible elements such as plastic dowels, wired flowers in posy picks and cake toppers. We will advise you of any non-edible elements that need to be removed before cutting and serving your cake.

7.2 We will not take responsibility for any non-edible elements that aren’t removed prior to serving. We will provide the venue the written information concerning any non-edible elements to be removed from your cake.

 

8. Shelf Life

8.1 We recommend that our cakes are eaten on the day of the event to be enjoyed at their best. Cakes deteriorate over time. All cakes are baked fresh to order and for your cake to be at its best it should be eaten on the day of delivery/collection. If there is a problem with your cake, it must be returned on the day of delivery/collection ( wedding cakes need to be returned on the day or the day after delivery/collection) and the problem will be dealt with. After this day we are not responsible for the cake.

8.2 Any cake that is left over can be frozen.

 

9. Allergens and Special Dietary Requirements

9.1 Inform us during your consultation of any allergies or special dietary requirements. It is the customer’s responsibility to make us aware of any special dietary requirements that need to be accommodated in the making of the cake.

9.2 Unless otherwise stated, all cakes contain; gluten, dairy and eggs, and are made in an environment that handles nuts, soya and dairy. Gluten-free, nut-free and dairy-free cakes can sometimes be made on request; however, we cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of the product.

 9.3 We would recommend anyone with severe nut, dairy or gluten intolerance does not eat our cakes.

9.4 We will provide allergen information with the cake upon delivery to the venue.

9.5 We accept no liability for customers suffering allergic reactions from eating our cakes.

 

10. Publication and Promotional Rights

10.1 We reserve the right to use any image of a customer's cake made by Fancy cakes by Rachel for publication on our website, Facebook and social media after the delivery date unless previously agreed in writing between the customer and the company.

10.2 The customer has no ownership rights over any cake design. Exclusivity of cake designs between our customers is not guaranteed unless the customer commissions an exclusive design.

 

11. Commissioning a Cake That is Similar to Another Design

11.2 If you wish to have us recreate someone else’s design, we do not directly copy it, but use it as a basis for the design of your cake, so that it is unique to you. This can be discussed at your consultation.

 

12. Display Item Hire

12.1 We have a range of cake stands, platters and other decorative items available to hire for your wedding. The cost of this can be discussed during your consultation.

12.2 Any hire is subject to a refundable damage deposit. This varies depending on the cost of the item/s being hired.

12.3 All hire charges and deposits are payable in advance, 14 days before the event date and will be detailed in the confirmation email.

12.4 Hired items must be returned to us within three days of the event date unless previously agreed. If items are not returned within 3 day’s then a late return fee of £5 per day per item will be charged.

12.5 If items are not returned within seven days, then the entire hire deposit will be forfeited.

12.6 If a late return has been previously agreed in writing, then no charges will be made if the items are returned by the specified date.

12.7 We do not collect hired items ourselves unless this has been previously agreed upon. A fee will be charged if we are required to collect hired items ourselves. This will vary dependent on the distance to the venue.

12.8 If items are returned damaged then the damage deposit will be forfeited. If the item can be repaired e.g., by obtaining a new part, then only the cost of this part plus an admin fee of £10 will be charged. If the item is damaged beyond repair, then the entire damage deposit will be kept to replace the item.

12.9 Please notify us as soon as you can if damage or breakage has occurred so we can assess the situation and advise of the best resolution.

 

13. Cancellations/Refunds

13.1 Deposits are non-refundable and non-transferrable in the event of cancellation.

13.2 Cancellations with less than 14 days’ notice are subject to full payment. If this has not already been paid, the final balance will be immediately payable upon cancellation.

13.3 However, if the wedding has been postponed and we are given more than 14 days' notice, it may be possible to transfer the deposit to the new date subject to availability. If we already have other cakes booked for your new date, we may not be able to supply the cake for you and your deposit will not be refunded.

13.4 There may be a rare occasion when we need to cancel an order. In this case, as much notice as possible of the cancellation will be given and any monies paid, including deposits will be refunded. This does not include a force majeure that may occur on the event day, e.g., extreme weather, epidemic and pandemic events, public unrest, unexpected traffic hold-ups or a road traffic accident that was not our fault and causing damage to the cake. In these cases, we would advise you to take out adequate wedding insurance to cover these eventualities, which are beyond our reasonable control. We reserve the right to revise and amend these terms and conditions. However, you will only be subject to the terms and conditions in force at the time you place your order with us.
